Contrary to what the general public might believe, marijuana is still illegal in New Jersey. As a result of this talk about legalizing marijuana has really given the citizens a false impression that marijuana charges are not taken as serious anymore. This could not be any further from the truth. New Jersey is still actively arresting, charging and prosecuting those caught possessing marijuana at an alarming rate. Possession of marijuana under 50 grams is by far one of the most common criminal offenses issued in New Jersey. It is considered a disorderly persons offense, which is also known as a misdemeanor. If convicted, an individual faces up to six months in the Somerset County Jail, a fine up to $1,000, fees and assessments nearing $800, probation, community service and a loss of license for up to two years not to mention a criminal record. Facing a THC Vape Pen Charge in the Borough of Somerville?

One of the most frequent inquires we get is, “Are THC Vape Pens legal in New Jersey?”, the answer is NO. Once the vape pen or   E-Cig is filled with THC oil or some form of a marijuana wax it becomes illegal to possess. Traditionally, anyone caught possessing a THC filled vape pen will be charged with a violation of N.J.S.A. 2C:35-10a(4), possession of marijuana under 50 grams, which as mentioned above is a disorderly persons offense. However, we have started seeing law enforcement charge individuals with a  violation of N.J.S.A. 2C:35-5.3c “Obtaining, possessing synthetic cannabinoid”, which is actually considered a fourth degree indictable offense. Anyone charged under N.J.S.A. 2C:35-5.3c will have to have their case transferred from the Somerville Municipal Court to the Somerset County Superior Court for disposition. If convicted under this subsection, an individual will be facing up to eighteen months in a State Prison, a fine up to $10,000, fees and assessments nearing $1,000, community service, probation and up a two year loss of license.
