Possession of Heroin with Intent to Distribute Charges Filed in Middletown

According to the patch.com, on Monday evening, the Middletown Police Department arrested and charged a thirty-five year old resident with numerous drug offenses, including possession of cds with the intent to distribute. Based on the reports, it appears that the officers first became aware of the Defendant’s alleged involvement in the distribution of drugs while investigating a serious of burglaries that had been occurring in the Oak Hill section of Middletown. Although the reports do not specifically indicate what information led them to investigate the Defendant, they do allege that he was involved in the distribution of heroin and Xanax. To make matters worse, when it came time to place the Defendant under arrest it was determined that he was in possession of cocaine, Oxycontin, amphetamines and a switchblade.

What Happens After I am Arrested in NJ

He was taken to the Monmouth County jail pending his Central Judicial Processing Hearing (CJP).  At his CJP hearing, the Defendant was advise that the prosecution was filing for detention. During a detention hearing, the prosecution will be seeking to convince the Judge that the Defendant must remain in the County Jail, without bail, pending trial. Regardless of whether or not the Defendant is detained, following his detention hearing, the matter will be set down for a Pre-Indictment Conference (PIC). A PIC, the prosecution and the defense will engage in plea negotiations. This will be done in an effort to resolve the case before it gets sent to the Grand Jury. The most serious offense is with both the possession of heroin and Xanax with the intent to distribute. These are third degree indictable offenses in New Jersey. If convicted, the Defendant will be facing anywhere from three to five years in State Prison and a fine not to exceed $35,000.
