Keith Oliver Criminal Law just finished up a case in Monmouth County that dates back to 2016. Our client was pulled over for what started out as a routine traffic stop. A subsequent search of his vehicle was conducted and it uncovered over an ounce of marijuana, drug paraphernalia, and an airsoft gun. Since the possession of marijuana with the intent to distribute charge was a felony offense, the case was transferred to the Monmouth County Prosecutor’s Office. After extensive negotiations with the Monmouth County Prosecutor’s Office, the charges were ultimately remanded back down to the local municipal court for disposition. This was a tremendous defeat in and of itself, as our client was no longer facing felony drug distribution charges. Not to mention that our client was currently participating in the Pretrial Intervention Program (PTI) for a previous BB-Gun offense at the time of his arrest.
Once the case was remanded back to the local municipal court our office appeared numerous times over a seven-month period. After extensive negotiations with the municipal prosecutor, it became apparent that they would not be able to prove the charges based on discovery and technicality issues. At the end of the day, all the charges were ultimately dismissed outright. So our client, went from facing a lengthy state prison sentence to having his charges outright dismissed.
