Middletown Man Facing DWI Charges

On February 20, 2018, the Middletown police were dispatched to Main Street and Sunset Place to investigate a motorist who may be suffering from a medical condition. When the officer arrived on scene and attempted to approach the driver, the driver’s motor vehicle rolled forward. In doing so, the vehicle actually collided with the officer’s patrol car. Following an in depth investigation, the officers came to learn that the driver was not suffering from a medical episode but was in fact under the influence of alcohol. Based on their observations, the driver was placed under arrest and charged with among other things, driving while intoxicated and possession of an open container of alcohol within a motor vehicle. The driver was taken to the Middletown Police Department, which is located at 1 Kings Highway, right next to the municipal court and processed. Upon being processed, the Defendant was released on his own recognizance on a summons to appear in court. It does not appear at this point in time that the Defendant was charged with assault by auto following the minor collision that took place.

Is DWI a Felony Offense in NJ?

No, a DWI offenses is actually considered a traffic offenses and not a criminal offense in New Jersey. However, this is probably the only lenient aspect of DWI offenses in New Jersey. In fact, some venture to suggest that the penalties for a DWI offenses are more severe than that of some disorderly persons offenses, which is New Jersey’s version of a misdemeanor.
