Arrested for DWI in Warren Township NJ

Warren Township, which is one of the larger townships in Somerset County certainly does deal with its fair share of driving while intoxicated offenses each and every year. One of the main reasons for that is because Interstate 78, which connects western New Jersey to New York City, cuts right through the township. Whether the individual was arrested and charged with DWI by the Warren Township Police Department or the New Jersey State Police, there case will be litigated in the Warren Township Municipal Court, which is located at 46 Mountain Boulevard. All DWI cases will be litigated in the Warren Township Municipal Court unless the individual was also charged with an indictable offenses, like assault by autoeluding, leaving the scene of an accident resulting in serious bodily injury or death by auto. If that is to occur, then the individual’s entire case, including the DWI charge will be transferred to the Somerset County Superior Court, which is located in Somerville for disposition. Is there Jail Time for a DUI Charge in NJ?

Possibly. As touched upon above, although DWI offenses are considered traffic offenses in nature, the potential penalties can be worse then some criminal convictions. Here is a chart below that explains the potential penalties.

1st Offense DWI If the Defendant’s BAC was .10% or below: $250-$400 Fine, 3 Month Loss of License, $325 Assessments, 12-48 hours in Intoxicated Drivers Resource Center, Up to 30 Days in Jail. If the Defendant’s BAC was greater than .10%: $300-$500 Fine, 7-12 Month Loss of License, $325 Assessments, 12-48 hours in Intoxicated Drivers Resource Center, 7-12 Months of Ignition Interlock Device if BAC is .15% or greater, Up to 30 Days in Jail.
2nd Offense DWI If the first offense occurred within the last 10 years: $500-$1000 Fine, 2 Year Loss of License, $325 Assessments, 48 hours in Intoxicated Drivers Resource Center, 30 Days of Community Service, 1-3 Years of Ignition Interlock Device.
3rd or Subsequent Offense DWI If the last offense occurred within the last 10 years: $1000 Fine, 10 Year Loss of License, $325 Assessments, 180 Days in Jail,  1-3 Years of Ignition Interlock Device.
