Possession of MDMA Charges Dismissed in Hunterdon County New Jersey

Drug Charges Dismissed Outright

Keith Oliver Criminal Law just finished up representing a client who was charged with various felony drug offenses following a routine motor vehicle stop in Clinton Township, New Jersey. According to the officers report, our client was pulled over for failing to turn his headlights on. After approaching the vehicle, the officer asserted that he observed that our client’s eyes were bloodshot, pupils were dilated, speech was slurred and the smell over burnt marijuana was emanating from inside the vehicle. Furthermore, the officer claimed that he noticed what appeared to be green vegetation on his lap. Based on all his observations, the officer began to question our client about whether their was anything else illegal inside the vehicle. A subsequent search of the vehicle was conducted and various items indicative of drug use was located inside the vehicle, including but not limited too:

  • Rolling Papers;
  • Tweezers;
  • Metal Grinders;
  • Vaporizer Pen;
  • Marijuana Pipe;
  • Marijuana;
  • MDMA Pills.

In addition, the officer discovered a marijuana joint located on the ground in the vicinity where our client was standing while the search was being conducted. Following their discoveries, the officers charged our client with one count of possession of MDMA in the third degree, one count of possession of marijuana under 50 grams a disorderly persons offense, one count of possession of drug paraphernalia a disorderly persons offense as well as one count of being under the influence of CDS also a disorderly persons offense.  Since our client was charged with a third degree drug possession charge, all of the charges were transferred to the Hunterdon County Superior Court for disposition.

Hunterdon County NJ Mental Health Intervention and Treatment Diversionary Program

After discussing the strengths and weakness of the states case, the prosecution agreed to allow our client to participate in what is known as the Hunterdon County Prosecutor’s Mental Health Intervention and Treatment Diversionary Program. This is a unique program that is exclusive to Hunterdon County. It allows certain individuals to participate in a mental health / drug abuse diversionary program whereby if they complete the program without violating any of the terms, the charges will be dismissed outright. This program is run very similar to the Pretrial Intervention Program, which is a statewide program. However, the benefit is that a successful completion of this program will not result in an individual from being blocked from the Pretrial Intervention ProgramConditional Discharge or Conditional Dismissal Program. So in the end, our client went from facing up to five years in a state prison to having the felony drug charges dismissed outright without having to use a diversionary program.
