Based on the reports that have been released thus far, it appears that the defendant had taken his HP Envy Notebook to a\u00a0Bridgewater Township\u00a0electronics store for repairs late last week. During the course of there repairs, an employee uncovered sexually explicit images of children, which he immediately informed the local authorities about.Local authorities then used that information to obtain a search warrant for the defendant\u2019s computer. Once the warrant was secured, the New Jersey Regional Computer Forensics Laboratory (RCFL) conducted an in depth\u00a0 forensic examination of the defendant\u2019s computer. During the search they discovered that the defendant was using an internet browser in an attempt to search for child pornography.\u00a0According to the reports, once the search warrant was executed, a warrant was issued for the defendant\u2019s arrest. The warrant was eventually executed on Monday at around 10:30 am when the defendant was taken into custody at his home in\u00a0Hillsborough. Once he was taken into custody, he was taken to the Somerset County Jail where he awaited his\u00a0Central Judicial Processing Hearing\u00a0(CJP). During this hearing the Somerset County Prosecutor\u2019s Office had to decide whether or not they will be filing a formal\u00a0Detention Motion. If they choose to do so, it will be up to the judge to decide whether or not the defendant will be detained in the Somerset County Jail, without bail, pending trial.Endangering the Welfare of a Child Sentence in NJThe endangering the welfare of a child statute in New Jersey is exhaustive. It covers a tremendous amount of conduct, including possession of child pornography. Possession of child pornography is considered a crime of the third degree in New Jersey. However, unlike most other third degree indictable offenses in New Jersey, anyone convicted of this offense would\u00a0not\u00a0obtain a presumption against incarceration. If convicted of this offense, an individual will be facing up to five years in a State Prison and a fine up to $15,000.
