According to nj.com who first reported the altercation, Howell Police Chief\u00a0Andrew Kudrick began investigating the incident following a video that was posted by the victim on Facebook. The video shows the Defendant irate, screaming at the victim about the way in which she handled a jug handle in Howell near\u00a0Herbertsville and Squankum-Allenwood road. The victim when on to further explain the bizarre encounter, stating that the Defendant began following her after the jug handle and at one point attempted to pass the victim on a one lane road. Then when the victim got to a red light is when the Defendant exited his vehicle and approached the victims. Not knowing what was going to happen next, the victim took out her cellphone and began filming the incident. Based on the footage in the film and most likely the victim\u2019s statement the Howell Police Department decided to issued a complaint against the Defendant for\u00a0harassment, in violation of NJSA 2C:33-4. According to the patch.com, this is not the first time that the Defendant was involved a road rage incident. Apparently last year in Brick, New Jersey the Defendant did the same thing to another women.The Defendant will need to appear in the\u00a0Howell Municipal Court\u00a0to answer for the charges. Harassment is considered a petty disorderly persons offense, which is the lowest level criminal offense in New Jersey. It is New Jersey\u2019s version of a misdemeanor. If convicted, the Defendant would be facing up to thirty days in the Monmouth County Jail, a $500 fine and a criminal record. If the Defendant does not have a prior criminal history, he could be eligible for one of New Jersey\u2019s diversionary program known as the Conditional Dismissal Program. If eligible and if accepted, the Defendant could walk away from this incident not only without ever serving a day in jail but without a criminal record as well. However, the Defendant could have to deal with a strong victim\u2019s opposition, which is one of the factors that is weighed when determining whether or not a Defendant is eligible.
