Authorities believe that the Defendant scaled to the third floor balcony of the apartment building in an attempt to burglarize the residence but when he got their he quickly realized he was not alone, he fled the area on a black bicycle. The homeowners quickly notified the authorities and the Defendant was apprehend. He was taken to the Mercer County Jail and formally charged with among other things, attempted burglary in the third degree. Since the Defendant already has five pending criminal court matters, the Mercer County Prosecutor\u2019s Office filed for a detention hearing. During that hearing they were able to convince the judge that the Defendant needed to be detained pretrial, without bail. That means that the Defendant will remain in the Mercer County Jail, without bail while his case winds his way through the courts.Detention Hearings in Mercer County NJIn January of 2017 the New Jersey bail system has forever changed. We in essence have done away with a cash bail system and have geared it more towards a risk assessment analysis. Traditionally, this has lead to more non-violent offenders being released and more repeat, violent offenders being detained without bail. With that being said, before a Defendant can be detained without bail, the prosecution must file for and be successful at what is known as a detention hearing. During the Detention Hearing it will be the prosecutions burden to establish by clear and convincing evidence that in order to protect society, assure the Defendant\u2019s appearance in court or to prevent them from obstructing the prosecution of their case, they must be detained without bail. So, in the case referenced above, the State was most likely able to convince the Judge that the Defendant must be detained based on the fact that he continues to break the law and is a danger to society.
