When the argument escalated, the victim alleges that the Defendant physically restrained her from leaving the apartment and was holding her against her will. When the Trenton police arrived on scene they placed the Defendant under arrest for the domestic dispute. However, during a search incident to arrest, the Defendant was determined to be in possession of two Oxycodone pills and a couple grams of marijuana as well.The Defendant was formally charged with one count of\u00a0criminal restraints in the third degree, one count of possession of a prescription legend drug\u00a0in the third degree and\u00a0possession of marijuana under 50 grams, a\u00a0disorderly persons offense\u00a0(misdemeanor). It does not appear that the victim filed for what is known as a temporary restraining order (TRO), which since the allegations involve a domestic dispute, the victim would have been entitled to apply for. Pursuant to New Jersey\u2019s bail reform, since the offense is classified as an \u201cact of domestic violence\u201d the Defendant was most likely taken to the Mercer County Jail so that pretrial services could conduct a risk assessment. Depending on how the the risk assessment goes, the Mercer County Prosecutor\u2019s Office could seek to detain the Defendant pretrial, without bail. Before that can occur, they must file for and be successful at the Defendant\u2019s Detention Hearing.
